Contoh Kasus

Seperti yang kita ketahui bahwa Samsung, Android dan Apple saling berselisih, diberbagai belahan Dunia saling tuduh menuduh tentang hak paten dan seakan tak berkesudahaan. Perang Hak paten antara perusahaan Tehnology terbesar ini ada artikelnya ada pada laman situs Bussinesweek yang amat panjang, tetapi menarik untuk di baca. Pada atikel BussinesWeek itu memaparkan perang paten antara Apple dan berbagai produsen yang memproduksi produk-produk Android dan juga artikel itu memberikan rincian bagaimana Apple terlibat dalam litigasi paten dengan sejumlah pembuat smartphone Android, termasuk Samsung, Motorola dan HTC.

“Dalam perang paten telepon pintar (smartphone), banyak hal yang dipertaruhkan. Perusahaan terkait tak akan ragu mengeluarkan uang banyak demi menjadi pemenang,” kata pengacara dari Latham & Watkins, Max Grant, dikutip dari Bloomberg, Jumat, 24 Agustus 2012. Menurut dia, ketika persoalan hak cipta sudah sampai di meja hijau, maka perusahaan tidak lagi memikirkan bagaimana mereka harus menghemat pengeluaran keuangan. Sebagai gambaran, Grant mengatakan, pengacara Apple diketahui memperoleh komisi US$ 1.200 atau sekitar Rp 11,3 juta per jamnya untuk meyakinkan hakim dan juri bahwa Samsung Electronics Co telah menyontek atau mencuri desain smartphone Apple. Perusahaan yang dipimpin Tim Cook itu juga sudah menghabiskan total US$ 2 juta atau sekitar Rp 18,9 miliar hanya untuk menghadirkan saksi ahli.

Meski kelihatan besar, uang untuk pengacara dan saksi ahli tersebut sebenarnya tergolong kecil dan masih masuk akal di “kantong” Apple ataupun Google. Sebagai contoh, biaya US$ 32 juta yang dikeluarkan Apple dalam perang paten melawan Motorola Mobility setara dengan hasil penjualan Apple iPhone selama enam jam.

Keduanya diminta menghentikan penjualan produk tertentu. 10 produk Samsung, termasuk Galaxy SII, tak boleh dijual lagi; 4 produk Apple, termasuk iPad 2 dan iPhone 4, juga demikian. Oleh pengadilan Korea, Samsung diminta membayar denda 25 juta Won, sedangkan Apple dikenakan denda sejumlah 40 juta Won atau setara US$ 35.400.

Kesimpulan

Upaya hukum pihak Apple pada bulan Februari lalu sempat mengalami kemunduran saat hakim Koh menolak permintaan Apple untuk melarang penjualan perangkat Samsung di Amerika Serikat. Menurut Koh, paten desain Apple terlalu luas dan bahkan beberapa di antaranya memiliki kemiripan dengan konsep yang ada di serial Knight Rider tahun 1994. Atas putusan tersebut Apple melakukan upaya banding dan menyewa sebuah firma hukum terkenal di Los Angeles untuk meningkatkan upaya perang paten yang sedang berlangsung.Keduanya diminta menghentikan penjualan produk tertentu. 10 produk Samsung, termasuk Galaxy SII, tak boleh dijual lagi; 4 produk Apple, termasuk iPad 2 dan iPhone 4, juga demikian. Saran

Pelanggaran yang dilakukan kedua perusahaan technology terbesar ini tentu akan membawa dampak yang buruk bagi perkembangan ekonomi, bukan hanya pada ekonomi tetapi juga bagaimana pendapat masyarakat yang melihat dan menilai kedua perusahaan technology ini secara moral dan melanggar hukum dengan saling bersaing dengan cara yang tidak sehat. Kedua kompetitor ini harusnya professional dalam menjalankan bisnis, bukan hanya untuk mencari keuntungan dari segi ekonomi, tetapi harus juga menjaga etika dan moralnya dimasyarakat yang menjadi konsumen kedua perusahaan tersebut serta harus mematuhi peraturan-peraturan yang dibuat.

Pada saat saya ingin pulang kerumah di taman dekat terminal bekasi saya melihat ada abang angkot buang air kecil sembarangan. Padahal di dekat taman ada WC umum tapi dia memilih buang air kecil di dekat taman. Hal itu sangat melanggar etika.

Pada saat saya di tempat umum saya melihat ada seorang bapak-bapak merokok. Walaupun di ruang terbuka, tetap saja itu tempat umum banyak perempuan, ibu-ibu dan anak kecil yang tidak merokok malah terkena asapnya. Dan itu sangat melanggar etika di lingkungan tempat umum.

Waktu saya keluar rumah, saya melihat seorang abang angkot membuang sampah sembarangan yaitu puntung rokok dan aqua gelas di pinggir jalan. Hal itu sangat melanggar etika di lingkungan sekecil apapun sampah itu sebaiknya di buang ke tempatnya, bukanya asal buang di pinggir jalan.

Waktu saya ingin berangkat dan pulang kampus saya melihat banyak pengendara motor yang tidak mematuhi peraturan lalu lintas. ada yang tidak sabar menerobos lampu lalu lintas, ada yang tidak menggunakan helm. Tentu saja hal ini sangatlah berbahaya untuk pengendara itu sendiri dan pengendara lainnya.

UK unemployment falls by 63,000 to 2.33 million

The number of people out of work in the UK fell by 63,000 to 2.33 million in the three months to January 2014, according to official figures.

The unemployment rate now stands at 7.2% of the population, the Office for National Statistics (ONS) said. ( 1. SIMPLE PRESENT )

The number of people in employment rose to a record 30.19 million, helped by a rise in the number of self-employed. ( 2. PAST TENSE )

Average earnings also increased, with pay in the three months to January up 1.4% from a year earlier. ( 3. PAST TENSE )

The number of employees in work fell by 60,000, but 211,000 more people were recorded as self-employed. ( 4. PAST TENSE )

There was better news for young people, as the number of unemployed 16 to 24-year-olds stood at 912,000 in the three months to January, a drop of 29,000 and the lowest level since 2011. ( 5. PAST TENSE )

In February, the number of people claiming Jobseeker's Allowance fell by 34,600 to 1.175 million. Over the course of a year, the number has dropped by 363,200. ( 6. PAST TENSE )

'Improving economy'
Employment Minister Esther McVey said the overall fall in unemployment showed that "the growing economy is helping record numbers of people to find a job". ( 7. INDERECT SPEACH-PAST TENSE )

"The rise in employment is being fuelled by businesses and entrepreneurs across the country who are feeling increasingly confident with the improving economy," she added. ( 8. PASSIVE VOICE )

Spending support
David Tinsley, an economist at BNP Paribas, said that while the employment figures were promising, there were some weak areas, pointing out that the rise in employment was down to the increase in the number of self-employed. ( 13. INDERECT SPEACH-PAST TENSE )

David Kern, chief economist at the British Chambers of Commerce, said that while youth unemployment had gone down, the rate was "still nearly three times the rate of unemployment as a whole". ( 16. PAST PERFECT )

Earnings "remain below inflation", he added.

Regional variation
The North East of England has the highest unemployment rate in the UK, at 9.5%. In the South East, where the rate is lowest, only 5.2% are out of work. ( 17. PRESENT TENSE )

The unemployment rate in Scotland fell to 6.9%, in Wales it was 6.7% while in Northern Ireland it was 7.5%. ( 18. PAST TENSE )

Just over 10% more men are employed than women in the UK, but the unemployment rate for men was higher than for women, with 7.4% of the male labour force out of work. ( 19. PAST TENSE )

There were 159,000 fewer people employed in the public sector in December 2013, compared with the September figure. However, a large part of this reduction was due to the privatisation of Royal Mail.

The figures for unemployment in the three months to January are based on the Labour Force Survey, in which the ONS speaks to 60,000 households once a quarter, making it the country's biggest household survey. ( 20. SIMPLE PRESENT )

The ONS is 95% confident that the unemployment figure is correct to plus or minus 81,000 people.

Recovery 'broadening'
Separately, the Bank of England released the minutes from the latest meeting of its Monetary Policy Committee.

The minutes showed that all nine MPC members voted earlier this month to keep interest rates at 0.5% and to keep the programme of quantitative easing unchanged at £375bn, as expected.

The MPC noted the recovery in the UK economy was widening beyond consumer spending.

"There were initial signs that the anticipated broadening from household to business spending might have already begun," the minutes said.

"Even so, there remained some way to go to ensure that the recovery was both balanced and sustainable."
